Terms of service

Plain terms for a small product. Where something is a real limitation, it says so rather than hiding in a clause.

1. What SimCenter is

SimCenter is a monitoring and remote-management service for simulator venues, operated by Martian Industries. You install an agent on computers you control; it reports their condition to our service and carries out actions you request.

By creating an account you agree to these terms. If you are agreeing for a company, you confirm you may bind it.

We will make reasonable efforts to keep SimCenter available and correct. Beyond that, be clear-eyed about what you are buying:

Your data is yours. We claim no ownership of anything your venues report. We use it to provide the service and to keep the service working, and nothing else — see the privacy page for the specifics.

You can export or delete it at any time. Closing your account deletes it within 30 days.

6. Our intellectual property, and attribution

SimCenter, its software and its documentation remain the property of Martian Industries. You are licensed to use it while your subscription is current; you may not copy, resell, rent or reverse-engineer it, except where the law says you may.

SimCenter displays the notice “A Martian Industries product”. Please do not remove, obscure, or reduce the prominence of that notice, the accompanying mark, or any copyright notice, in any copy or deployment.

7. Acceptable use

Do not use SimCenter to monitor people rather than machines, to access equipment you are not entitled to, to break the law, or to attack the service. We may suspend an account doing any of these, and will tell you why.

8. Liability

Nothing here limits liability for death, personal injury, or fraud, and nothing removes rights you have under consumer law.

Otherwise, and to the extent the law allows: SimCenter is provided “as is”. We are not liable for indirect or consequential loss — including lost bookings, lost revenue, or lost reputation — and our total liability in any twelve-month period is limited to what you paid us in that period.

Said plainly: if SimCenter fails to spot a broken bay and you refund a customer, that refund is yours. We will fix the bug and we would like to hear about it.

9. Ending it

You may close your account at any time from the app or by asking us. We may end an account for breach of these terms, or with 60 days' notice if we stop offering the service — in which case we will refund the unused part of anything you have paid and help you export your data.

10. Changes

We may update these terms. Material changes come with 30 days' notice by email. Carrying on using SimCenter after that means you accept them; if you would rather not, cancel and we will refund the unused period.

11. Law

These terms are governed by the laws of the Commonwealth of Pennsylvania, United States, and its courts have exclusive jurisdiction.

A note on this document

These terms were drafted to be honest and readable rather than maximally protective, and they have not yet been reviewed by a lawyer. If you are a customer with a procurement process that needs something more formal, say so and we will get proper wording rather than pretend this is it.
